How to Serve a Suit on a Hiding Defendant

Debt Collection Michigan

Alternate service works best against a defendant who’s hiding from the process server, not one who has moved to parts unknown. If the defendant no longer resides or does business at the address you’ve listed on the summons, skip trace him or her before seeking an order for alternate service. Otherwise you may find yourself fighting a motion to set aside your default, or unable to register your judgment for enforcement in the new state where the defendant resides, based upon the claim of improper service.

Should You Hire an Attorney? Consider Your Case Complexity & Cost.

Debt Collection Michigan

When you choose whether to handle a case yourself, two factors usually dominate your decision-making process:

  1. Cost: How much will it cost to litigate your case, with or without a lawyer?
  2. Complexity: Is the case too difficult or too time consuming to handle yourself?

Ideally, before you file your case, you should have a pretty good handle on the cost of getting a judgment and whether the case is simple enough for you to handle without a lawyer. At a superficial level, the question of cost seems easy, but cost increases with the complexity of a case.

What You Need to Know Regarding Debt Collection Telephone Call Restrictions

Debt Collection Michigan

The FDCPA imposes some specific restrictions on your collection phone calls to debtors. Follow these guidelines:

  • Collection Calls should be made during normal business hours to avoid harassing the debtor.
  • Normally, calls should be made between 8a.m. and 9p.m. However, if the debtor indicates in writing that he would prefer to be contacted at another time, then you must respect that request to avoid harassment under the FDCPA.
  • If you are told in writing not to contact a debtor at work, you must stop calling.
  • Even on the phone, communications governed by the FDCPA must include the warning that you are “a debt collector attempting to collect a debt.”

What are some steps for collecting a debt from the
deceased's estate?

debt collection Michigan Conventional pre-and post-judgment remedies are no longer effective after a debtor dies. For example, if you garnished a bank account or the income of your debtor who died, your garnishment will become ineffective because the assets have either passed to an heir (done automatically with joint accounts) or the probate court now has all the assets. Assets pass to heirs or the probate court upon death.

You must file necessary paperwork to file a claim on a deceased debtor’s estate. Learn more here!

Can I File a Claim Against the Deceased Debtor’s Estate?

debt collection Michigan
Yes. When an individual who owes you money dies, you should follow up for collection. You do this by filing a proof of claim with the person’s probate estate in the probate court of the county where the debtor resided. Check with the probate court where the estate was filed, as it may have a standard claim form for creditor’s claims.

Debt Collection Laws Protecting Our Military

Do you have debtors in the military?

Unfortunately, it can be a little bit more difficult to see any money from these debtors.
debt collectors Michigan

The Servicemembers Civil Relief Act (SCRA) provides protection to members of the military assigned to federal active duty so that their legal rights aren’t adversely affected by their military service.

Among the provisions of the SCRA, military members have the right to request a stay of civil court proceedings and may be able to secure relief from default judgments obtained while they’re on active duty. Upon notice to creditors, they may be eligible for reduced interest rates on their debts.

What happens once you file a lawsuit?

debt collection MichiganAfter the defendant has been served, one of two things happen:

  • The defendant files an answer, placing the case at issue. The clerk then sets the matter for a hearing.
  • The defendant doesn’t file an answer with the court, and you ask the court to enter a default judgment in your favor.

If the defendant answers your complaint but is unwilling to settle, a trial is held, followed by an entry of a judgment by the court. If you win, your judgment will describe the specific amount of money the defendant owes you and establish your legal right to collect the money from him or her.

What is a Debt Collection Lawsuit?

debt collection MichiganA debt collection lawsuit is the strongest measure you can take to enforce collection of an unpaid balance. It involves filing a summons and a complaint with the court; the defendant/debtor then has some options:

  1. Contesting your case by filing an answer and – under the right circumstances – also a counterclaim against you.
  2. Making arrangements for payment, which when complete results in a dismissal of the cases.
  3. Ignoring the lawsuit, which results in the court entering a default judgment in your favor.

Factors You Should Consider for Successful Execution of Seizures

Have you created a list of assets owned by your debtor?

Are you prepared to fight for every dime you’re owed?

Are you well aware of things that can complicate your claim?

You have many factors to consider that can potentially weigh against proceeding with execution. Possible concerns include:

    debt collection Michigan
  • How the property is owned. If the property is owned by more than one person, you may only be entitled to a portion of the value, or nothing at all.
  • Tax liens and secured creditors. Prior lien holders have priority over the assets you seize, meaning they must be paid first out of the sale proceeds.
  • Special rules may apply. Restrictions apply to execution against the assets of cities, townships, school districts, and states.
  • Practical considerations. Avoid spending more on the process than what you’re going to get out of it, because you’ll get stuck with the bill.

How to Create a Solid Plan for Successful Seizures

Given the cost of execution and the chance of being stuck with the bill, it makes sense to have a solid plan in mind before you initiate the process. First, you want to be sure that your debtor has enough assets to cover the cost of this process, and ideally, to also cover most or all of the amount owed on the judgment.

Start by gathering accurate and specific information that a court officer or deputy sheriff can use by:
debt collection Michigan

  1. Creating a list of assets owned by your debtor.
  2. Double-checking your files to make sure the information on your list is accurate.
  3. Preparing a cover letter containing that information is for the benefit of your officer.

Tips to Prepare to Be a Witness in Court

debt collectors MichiganNever been a witness before?

Are you not sure what to expect?

Worried about your testimony?

Here are some tips we recommend to ensure your experience as a trial witness goes smoothly include:

  1. Talking to your attorneys before trial can help prepare you for court. They may even be willing to walk you through the testimony itself.
  2. Listen carefully! During a trial, while a defense witness is testifying, it’s helpful to take notes describing your thoughts and observations.
  3. Answering questions in court. Some of the questions your attorney may ask may seem unnecessary, but they’re foundation questions that the attorney must ask in order to introduce evidence or to make a particular point to the court.
  4. Offering documents into evidence. When introducing evidence, your attorney must follow requirements set forth in court rules and the rules of evidence. Your lawyer may ask you questions intended to lay down a foundation (a legally sufficient basis) for the admission of an exhibit into evidence.
  5. Handling cross examination. On cross-examination, an attorney wants to lead you into making admissions that are harmful to your case, to embarrass you, to show that you’re ignorant, incompetent, biased, not to be trusted, and so on.

What You Need to Know About Being a Witness in a Trial Court

debt collectors in MichiganTestifying at trial is intimidating, particularly the first time you take the stand. As long as you’re prepared, you have nothing to fear. Most states forbid lawyers in small claims court, so your case will probably be heard in a regular trial court. Although the general procedures of a trial court are the same as small claims court, more formalities must be observed in trial court.
