Can I Get the Debtor to Pay My Attorney Fees if I Have to Hire an Attorney to Collect My Debt?

Is taking people to court costing you an arm and a leg?

Do you want to collect on attorney fees and interest?

Do you have many delinquent accounts that are causing you anxiety and stress?

Here’s what you need to know:

According to Courts.Mi.gov on attorneys fees, Michigan follows “what is commonly referred to as the ‘American rule’ with regard to awards of attorney fees. As a result, attorney fees are generally only recoverable as provided by specific statute, court rule, common-law exception, or contract.”

“If Someone Owes Me Money and Refuses to Pay it, What Should I Do?”

Does someone in Michigan owe you money?

What should you do?

There are many common sense strategies to help you collect on money you’re owed. To help you organize your thoughts as you consider how to enforce a debt, please review this handy list:
debt collection attorney michigan

  1. Start by simply asking for the money you’re owed.
  2. Discuss alternate forms of payment.
  3. Convey a sense of urgency and include consequences for their failure to pay.
  4. Continue trying to escalate your collection activities. If you can’t reach a resolution, it may be time to contact a debt collection attorney in Michigan.
  5. If the amount owed is within the small claims limit ($5,500 or less at this time), you can file your claim there. Keep in mind that you are not allowed to have an attorney represent you in small claims court.
  6. If your claim is over $5,500, you can file in district court; if it’s over $25,000, you can file in Circuit Court. It is almost always better to retain an attorney to represent you in these courts.
  7. We recommend that you consult or hire a debt collection attorney.
  8. Be sure to file the proper forms on time before the statute of limitations expires.
  9. Prepare for your court date with as much evidence you can gather to ensure you don’t get cheated out of what you are owed. If you hire an attorney, he or she can advise you on what evidence you may need.
Creditors have rights too! Don’t let the money you’re owed for your time and services go uncollected. You deserve to get paid for products and services you’ve provided. If you fail to pursue legal action against a debtor the value of your work could be lost. Protect yourself today and call an expert debt collection attorney in Michigan to discuss your rights!

What is a Judgment?

A judgment is an order from a court that has jurisdiction over your debtor. It states with certainty what your remedy is … in collection lawsuits, that is almost always a specific amount of money. Sometimes an interest rate and a payoff period are also included. Once the judgment is issued, there is no more arguing about how much is owed or by when.

If your debtor doesn’t pay the entire amount of the judgment (or fails to make a payment within the specified time), you can seek a “default,” and you may be able to collect against some property the debtor owns, or against some payment he or she receives. For example, according to Nolo, “property the creditor can take varies from state to state. Usually, the creditor can go after a portion of net wages (up to 25%, more if the judgment is for child support), bank and other deposit accounts, and valuable personal property, such as cars and antiques. However, every state has certain property it declares exempt.”

“I Want to Collect on Fees and Interest”

Are you worried your case is going to settle for pennies?

Do you want the best settlement possible?

Can you ask the court for collection fees and interest?

However, if you want a debt collection attorney in Michigan that will fight for your creditor’s rights, Muller, Muller, Richmond, Harms, & Myers, P.C. is the firm you can trust.

Interest can be charged on delinquent accounts and enforced in the state of Michigan, but it needs to be incorporated into your application of credit or contract. We’ve tracked down overdue accounts for over 55 years! We’ll handle your case with the professional attention it deserves and we’re well prepared to use all our options to collect your overdue debts.

6 Questions to Ask When Selecting a Debt Collection Attorney

Are you worried you’ll make the wrong choice when selecting an attorney to handle debt collection in Michigan?

To ensure you’re working with qualified debt collection attorneys, ask these questions during your initial consultation:
debt collection Michigan

  1. Will I be required to sign a “retention” agreement?
  2. Is the firm a real firm with real attorneys, or are they just debt collectors?
  3. What are your collection rates? Is there any fine print?
  4. Is the firm experienced in commercial B2B collections?
  5. Is the firm qualified to give “true” legal advice? Can it protect my legal rights?
  6. Do you offer a satisfaction guarantee?
Pay close attention to the answers given to you by your potential attorney. If they seem unqualified, they may have little experience in the field.
