What You Must Know About Creditors Lien Rights

There are several things you can do to get money you are owed, such as a property or judgment lien to satisfy debts. Typically, a creditor will obtain property liens only in limited circumstances. However, creditors may obtain judgment liens when a lawsuit is filed against a debtor for an outstanding debt.

How to File a Property Lien:


When a debtor volunteers a property lien arrangement – the creditor may take action to repossess or foreclose on the property a debtor pledged as a security interest. The creditor must perfect the property lien. State law typically requires the creditor to "perfect" the property lien by recording it with the state. The creditor must remove this lien once a debtor pays the corresponding debt in full.”
